What a notice needs

Send whatever you have and we will act on it. A complete notice under 17 U.S.C. 512(c)(3) includes:

  1. Your signature, physical or electronic, as the owner or somebody authorised to act for them.
  2. What work you say is infringed. A title is enough.
  3. Where it is on Tavern Bag, specifically enough that we can find it. An entry name and a book title is ideal.
  4. How to reach you: address, phone or email.
  5. A statement that you believe in good faith the use is not authorised by the owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information is accurate and that you are authorised to act for the owner.

We will act on an incomplete notice too. These elements matter for the legal process, not for whether we listen to you.

What we do when one arrives

  • We remove or disable the material expeditiously. In practice that means within one business day, and always within three.
  • We keep a record of the notice, what came down, and who acted on it.
  • If you tell us a whole book is yours, we remove the whole book, not one entry of it.
  • If a user uploaded it, it counts against their account under the policy below, and they are told the reason the next time they try to add anything.

Repeat infringer policy

It is our policy to terminate, in appropriate circumstances, the accounts of users who repeatedly infringe copyright.

In practice: a valid notice against material a user uploaded is a strike against that account. 2 strikes and we suspend the account pending an explanation, which means it can still read its library but cannot add to it. 3 strikes and we terminate it and delete the content it uploaded. A strike is lifted if the notice is withdrawn or successfully countered, and an account that drops back under the line is restored.

We also terminate outright, without counting strikes, where an account is plainly being used to redistribute commercial books to other people.

Deleting an account's uploads is not reversible. Lifting a strike restores the account, not the books, and those can be imported again.

If we took down something that was yours to post

Send a counter-notice to the same address with: your signature, what was removed and where it was, a statement under penalty of perjury that you believe it was removed by mistake or misidentification, your name, address and phone number, and your consent to the jurisdiction of the federal court for your district. We forward it to whoever sent the original notice and may restore the material in 10 to 14 business days unless they file suit.

What is here and why

The shared library is limited to material a licence lets us publish. Every license and the credit it asks for is listed on our licenses page. Anything a user imports is private to that user's account, is never shown to anyone else, and is never merged with another account's copy.
